12 July 2010 One of our client company which have present paid up capital Rs. 7.43 Crores not appointed company secretary in whole time employment . AS per company act it is applicable in the year of 2006-2007 to company to appoint CS in whole time practice. Company also not filed Compliance Certificate for that period. What steps we can take in this situatuion.

as per my understanding from your query is that your client company is required to appoint the CS in full time employment since 2006-07 but it has not been appointed. now you may take the following solutions:

1. Appoint the Company secretary in the full time employment.

2. file the application for Compounding.
