02 September 2011 1. Can we avail service tax credit on Xerox copies?? If not then pl. provide under which rules it is not applicable.
2. A service provider has raised a bill to us by adding wrong value & also calculated service tax on wrong value but we have paid the same as per the contract & also calculated service tax on agreed value. So, now my question is whether we can avail credit on such corrections done by us or needs to be impact sign & stamp of service providers on such corrects.
3. In inward transportations, transporters are mentioning that service tax to be born & paid by the consignee but they never mention any service tax amount in bills. So, my question is can we eligible to take credit in our books, If yes then on which mechanism system to be followed.

02 September 2011 1. Xerox copies are not input service, input credit is available only on the input services/ capital goods, used in providing taxable services or goods to be cleared on payment of excise duty.

2. issue a debit note to the service provider for such correction, and then avail input credit of actual service tax paid. ask for a credit note from service provider.

3. under GTA the person who pay to the transporter is liable to get registered and pay service tax.
such service tax can be taken credit, if the service is used for inward transportation of goods, but not available for outward

For Q.No. 1. - As original being misplaces we have availed the service tax credit on photocopy of such invoices. So, is it admissible????

02 September 2011 company can re-generate the invoice in place of missing invoice, as xerox copies of documents are not valid unless the original is annexed with, or its certified by the issuing authority to be treated as original.

and when the document is misplaced, then xerox done of what?
