19 October 2013 DEAR ALL,
I VE A QUERY RELATING TO COMPANY LAW
WE HAVE A COMPANY WHICH HAD VOLUNTARILY STRUCK OFF ITS NAME FROM ROC IN 2006.
NOW IN 2013 IT HAS RESTORED ITS NAME AND NOW WILL START ITS NORMAL OPERATIONS.
MY QUERY IS SHOULD THE COMPANY NOW FILE ITS ANNUAL RETURNS FOR THE PERIOD BETWEEN 2006-2013???
AS PER THE COURTS ORDER IT IS MENTIONED THAT "THE COMPANY NEEDS TO OBTAIN DIN AND ALL PENDING STATUTORY RETURNS ELECTRONICALLY.THE PETITIONER COMPANY SHALL FILE ALL STATUTORY RETURNS AND COMPLIANCES ELECTRONICALLY UNDER VARIOUS PROVISIONS OF THE COMPANIES ACT,WITH ROC WITHIN A PERIOD OF 8 WEEKS"

SO DOES IT INCLUDE ANNUAL RETURNS??
IF YES,WHAT WILL BE THE DATE OF AGM?

19 October 2013 i) Hard copy of the court order may be filed offline to the Jurisdictional Registrar of Companies.

ii) Also request the ROC to enable MCA21 site to file the pending documents. On enabling, the status will change from 'struck off' to 'active in progress'.

iii) Then file Annual return (e-form 20B), Balance sheet (e-form 23AC), Profit and loss account(e-form 23ACA) and Compliance certificate(e-form 66),if applicable, for all the pending years with in the time allowed by the HC.

iv) After approval of all the forms filed, the status will change from 'active in progress' to 'active'.
