22 December 2010 We have appointed a new director in place of existing and filed Form No. 32 for Intimation in ROC and also filed Din 1. Should we file Din 2 and Din 3 or not for appointment of new Director.

Yes you have to file DIN 2 and 3 with the statutory time lines.

Company to intimate your DIN to ROC

After the Director has intimated the DIN allotted to the company(ies), the Company(ies) is/are then required to intimate the DINs of its directors to the ROC in Form DIN-3 within a period of seven days of receiving form DIN-2.

There is no need to file DIN 3 with ROC if appointment is made on or after July 01, 2007.

My opinion is different from the experts..

In case the Person to be appointed as on today as Director does not have a DIN, apply for his DIN in Form DIN - 1. After he has been allotted a DIN u can directly upload Form 32. If he is appointed as Director after 30.06.2007, no need for DIN-2 and DIN-3.
