our company has paid Rs 40,000 in cash for treatment of employee in hospital. Whether we can cliam the expenses of Rs 40,000 made in cash in P& L A/c or not.

Cash payment of Rs. 40000/- to hospital would be disallowed, unless you have any reason as per exemption/s provided in the act... e.g. payment made on banking holiday etc..
