Is rebate u/s 87A avaliable for Short Term Capital Gain on sale of Property on. Total Income 856511 including Short term capital gain of 165480 on Sale of Property. Excel Utility of ITR 3 for Fy 2025-26 is allowing rebate. But is it theoratically correct

Yes, it is theoretically and legally correct. STCG on real estate is taxed at standard slab rates rather than a special flat rate. Since total income (₹8,56,511) is under the ₹12,00,000 threshold for FY 2025-26 under the New Tax Regime, the Section 87A rebate fully covers the tax liability.
