Capital gain liability builder returns money

This query is : Resolved

Quick Summary
A friend purchased property from a builder with a cheque, but the registry was never completed. Years later, the builder returned the money with an additional sum. The query concerns the income tax impact of this extra money, specifically if long-term capital gains tax applies. The discussion clarifies that if no registry took place and the property was returned without a sale, the focus is on the documentation proving the return of funds, such as a property purchase agreement and a letter or bank statement confirming the money's return.
