Dear Experts,
We are the first auditor of a Public Ltd unlisted Company. We were appointed within 30 days of Incorporation of company, but we have not yet filed Form 23B to ROC.
1. Is it necessary because it is not mandatory for the first auditor to intimate ROC about his appointment? Please clarify?
2. If filing is necessary then if we file Form 23B now, there is a late fine charged by ROC, how can we avoid it?
if DPM DOA are not entered but depreciation is claimed in P&L & B/S will rise to increase in tax in ITR utility
and accordingly due to negligence ITR was filed & a demand notice equalling to tax amount on the dep was served to the assessee.
moreover, return waas filed on the last date of A/y (belated return)
So return cannot be revised or rectified either because dep has given rise to change in GTI
Now what is the possible solution??
Moreover, Depreciation is mandatory to claim, i think deptt cannot merely disallow it by non filing of DPM DOA
Dear Experts,
During the FY 12-13 year closure we have created provision for expenses for Rs 10 Lacs and TDS of Rs 1 Lacs has been deducted by passing the entry
Dr Expenses 10 Lcs
Cr Provision for exp 9 Lacs
Cr TDS us 194 J 1 Lacs.
In the month of Apr'13 also we have not received the invoice copy's.
Now how to make the TDS payment of rs 1 lacs.Can i pay TDS against provisions directly?
Should i wait till i get the bill? what about the Interest and penalties i.e 1.5 % PM etc..
Is there any way out to avoid the interest costs?

Hi,
We as Employers have missed depositing a part of the salary TDS deducted (for FY 2012-13). We did pay the other part TDS Challan on time (before 15th May 2013 for Financial year 2012-13) and TDS return was also filed.
Some Rs. 50,000 TDS (pertaining to a single employee, whose record is included in the TDS return filed i.e. 24Q) has been missed. We know it is a big mistake.
Now is it possible to pay a new TDS Challan (pertaining to this amount with interest and any penalty due) and then correct the TDS return filed at TIN Facilitation centre.
If such correction is possible, will we be able to get corrected Form 16 (from Traces Portal)?
Please advise. Any help will be great.

suppose a company get bill from a shipping company as on 15.03.2013 (when shipment move ) and he raised the bill to his customer as on 10.4.2013 (when shipment reached )
1)so where to book expense and income in f.y 2012-13 or in 2013-14
2)so now here if he record that expense as on 10.04.2013 against it's income ( as per matching concept )
3)it is right way to book the expense and income or it is prior period item
4)is here matching concept and accrual concept are conflicting
because as per accrual concept when expenses accrued we have to book but as per matching concept income and expense should be record in the same financial year
