26qb

Property was purchased on 30.08.2017 for 80 lacs.

Full payment was made of Rs.80 Lacs to seller and no tds was deducted.

Now, on getting knowledge of provision, decided to deduct tds of 80000/- after taking payment from the seller.

What would be the consequences and demand and interest and late filing fee, if any.

Thanks in advance

Hi

I have received a defective return with error code 86, and need to re-file the return under section 139(9)
I had prepared the return online, hence not having any XML. However, when I go to resubmit, it is asking for new XML.
Is there a way to get the XML for the return filed originally, or I need to create the XML manually.

Thanks in Advance !

Gstr3b return for jewellers

My question is, if we file GSTR3B for jewellers, is it compulsory to disclose details of URD (from customers, The old jewellery given by the Customer does not constitute supply under GST law. As per section 7 of the CGST Act, one of the essential elements of supply is furtherance of business of the person making the supply. In the instant case, sale of personal jewellery by a customer does not constitute furtherance of business by the customer.)

according to this rules for jewellery business, is it still mandatory to show URD PURCHASE in TABLE 5.0 IN GSTR3B? OR IN OTHER TABLE?

Gst registration

One assessee had duly obtained provisional registration under the GST regime. He made sales and purchases on provisional GST registration and deposited the tax accordingly. But due to some reason he could not complete the final process of migration under the GST regime. And, now his provisional registration number on GSTN is shown as cancelled. Due to which he is not able to upload the returns under GST. Please suggest as to what can he do to activate the registration on GSTN so that he and his customers can get the credit of input tax. If activation is not possible what he should do to avoid any future problem.

Dear Friends, One of my client sold a flat in Mumbai. This flat was his ancestral property which he got after demise of his father. This flat was in quite an old building and hence all the members of the Housing society entered into an agreement with one of the builder to reconstruct the building and allot them a comparatively smaller flat. Entire cost of construction was born by the builder for which he received some flats. After getting the possession of the new flat my client sold the flat. My query is : If the previous owner (father of my client ) held the property for more than 20 years but time duration between my client becoming the owner (after his father’s death) and selling the flat developed by builder is less than 36 months will he be able to claim exemption u/s 54 if he invests in another flat. I want the opinion from the specific angle that the old flat is not sold rather a new flat of different size (allotted to him in place of old flat by the builder ) is sold which my client hold for less than 36 months before it was sold. Pl reply and oblige. Thanks in advance for your cooperation.
