Composition VAT

Suppose Composition Dealer ka Aggrement 100000.00 ka Hai

Sale 100000.00
TDS 2.266% - 2266.00 Claimed in I.Tax
VAT 1.50% - 1500.00 Shown in VAT Return
Labour Cess - 2000.00 Kis Ledger ma Jayga

Balane Recd. 94234.00

Trading Ma Jab Sale Ke Entry Book Karte Hai Tab VAT (Under Duties & Taxes Group) Ki Liabilities Khade Kar Deta Hai and Isko Input VAT ka against adjuste karne ka bad Balance Ko Deposite Kar Deta hai.

Is Case VAT Ka Treatment Kya Hoga, Kyoki Sale Ke Entry Ka Time Par VAT to Khada Nahi Hua, Balki Jo VAT Bana tha vah to Kat kar payment Mile Hai.

Also Labour Cess Ko Kis Ledger Head Mai Entry Karange.

VAT Ka jo Certificate Melage Uska Kya Benifit Lenga.

TAX ON FOOD COUPONS

WHETHER FOOD COUPONS GIVEN BY THE EMPLOYER IS TAXABLE IN THE HANDS OF EMPLOYEE IF EMPLOYER IS NOT LIABLE TO FBT AFTER ABOLITION OF FBT?

IF NOT UPTO HOW MUCH LIMIT IT IS NON-TAXABLE? RS. 50 PER MEAL OR MORE THAN THAT.

IF IT IS EMEMPTED UPTO RS. 50 PER MEAL, THEN FOR HOW MUCH MEAL PER DAY IT IS EXEMPTED?

Applicability of VAT and Service tax

In a software products company, the company is raising an invoice for the sale of software licence. Normally it would charge VAT on the sale. However, the relevant authorities are insisting that they charge and pay service tax on the same as well.

Hence currently, the company is raising an invoice with the value of the licence osale, Service Tax of 10.3% on the licence value plus VAT of 4% on the licence value, which constitutes the total invoice value.

Is this the practice to be adopted? If not, can anyone quote relevant sections/ rules/case laws on the right method?

amalgamation

A company is amalgamated with another co. "Appointed date" as per High Court's order is 1/4/2008. For the purpose of facilitating amalgamation the transferor company was made fully owned subsidiary of the transferee company on 10/5/2008. The "effective date" of amalgamation and date of passing order is 26/08/2008. Does that constitute that the transferor co became subsidiary of transferee co before amalgamation?
