Hi, I am a salaried Indian Resident and want to appear for the PMP certification examination held by PMI Institute USA. The examination fee is 405 US $ and the membership fee is 149 US $.
While making the payment to PMI for the above-said certification examination the PMI institute is charging me 99.72 US $ as TAX, which is exactly 18% (GST %) of the total amount payable i.e. 554 US $.
Please advise on the following :
1. Is TAX applicable for examination fees and membership fees also? If not, then how can I claim the paid TAX amount?
2. If I make the payment can I claim an income tax deduction while filing income tax returns for the FY 2023-24?

One of my friends received a notice from the service tax department last month. For the purpose of loan his auditor was declared 40 lakhs gross income and they filed the income tax under civil contractor works. Since he's having rental income from residential properties, the department insisted that he has to pay the service tax of Rs. 6lakhs. Kindly help me out how to deal with this.

One on my client got the Demand of Service tax on the basis of 26AS. Client is providing labour to DHBVN and the heading of work contract is erection / testing /etc.
Also DHBVN is deducting 15% /14.5% in the name of Service tax from the payment.
is there any remedy/case law??

i m working as Architect we provide architectural service to local body (municipal corporation ) for their project planing as architect in 2015-16 project such as fire brigade building , school building ext similar buildings , as above notification show "Services provided to the Government, a local authority or a governmental authority by way of construction, erection, commissioning, installation, completion, fitting out, repair, maintenance, renovation, or alteration ...." are exempted in service tax ...
now department said me to pay service tax + fine +interest ...They say architectural service is not covers under above notification ..
My quotation is - is architectural service is exempted as per above notification or not???
plz guide me .

I have one doubt about the levy of service tax on sub-contract works towards constructing branch canal/dam works around 11 km.
Let's briefly narrate hereunder for the pattern of works :
Sardar Sarovar Narmada Nigam Limited (Government Undertaking company) allotted said works to "A" who is the main contractor amounting to Rs. 750.00 lakhs (which is exempt from service tax as such works are government works), and, some portion of said works extent to Rs. 500.00 lakhs had sub-contracted to "B" who is the sub-contractor from the main contractor with executed necessary work order, wherein the liability of service tax mentioned as aforesaid works are failing under negative list and exempted from the service tax as per notification No. 25/2012, dated. 20/06/2012 .
Now, The service tax scrutiny is ongoing and the final SCN issued by the officer alleged as you are not entitled to take any exemption benefit with said notification for aforesaid works after considering our submission of all documentary evidence and explanation as well. The main core allegation by the officer is the service tax applicable in hands of "B" sub-contractor as he provided service to a private (personal) contractor, not directly to a government company, however, the Main Contractor 'A" is entitled to get exemption of such notification as he had provided service to direct government undertaking company for aforesaid works is not for public uses such like road, airport etc.
During the personal hearing of the such matter, the officer strictly denied the above exemption and said that the said notification does not apply to the sub-contractor even though he works canal works.
We will make plans to reply of SCN withstand that service tax liability is exempt for us as already mentioned in the work order which issued by the Main Contractor, so is it enough or any other points require in defense to prevent such liability?
