My client has got the contract for construction of residential complex , on labour rate & consumables.

The company has deducted 50% service tax and claimed the above service under work contract service .

i want to know that pure labour contract + consumables comes under work contract services .

what will be the taxation procedure for contractor ( partnership firm)

Regarding service tax registration

DEAR CA CLUB FAMILY MEMBERS,
MY QUERY IS REGARDING SERVICE TAX REGISTRATION.
IF A NEWLY CREATED COMPANY REGISTERED THEIR SERVICE TAX REGISTRATION BY MISTAKE AS NON ASSESSE
1)COULD IT CAUSE ANY PROBLEM TO COMPANY?
2)HOW TO CHANGE IT TO ASSESSEE AND WHAT IS THE PROCESS TO BE FOLLOWED?

Construction activity

We are having service tax registration number, but from 3-4 years we not given any bill to our client as there is no sales.

My query is if we are issuing our bill to the client then is it chargeable to service tax or we can ignore???

If we can ignore in which circumstances or what will be conditions for that and procedure, if any??

Hiring of motor vehicles

Renting or hiring of passenger motor vehicle falls under reverse charges mechanism of service tax, if service tax paid with abatement service receiver has to pay 60% but service tax paid without abatement serviece receiver has to pay 100%.Now my query is when service receiver can choose payment of service tax @60% & 100%.In my opinion If service provider has not charged service tax in his bill then service receiver has to pay 100%? or when service provider charged service tax @40% then service receiver has to pay remaining 60%?.If above implication is wrong Please clarify my doubt

Please Comment on this Point: "The Cenvat Credit shall not be utilised for payment of tax dues under the schemes." TAX due means, I want to pay service tax period from 2008 to 2012 under this schem, whether Cenvet Credit cannot be utilised? What is the reason for not giving Cenvat Credit.... Waiting for reply.....
