Cenvat Credit on line Rjection Material

I HAVE SOLD SOME MATERIAL TO MY CUSTOMER FOR 100000/- AND WHILE PROCESSING ON THE MATERIAL THEY REJECTED THE MATERIAL AND SEND IT BACK TO US ON SALE INVOICE MENTIONING LINE REJECTION.AFTER CHARGING EXICSE DUTY

PLEASE TELL ME CAN I TAKE CENVAT CREDIT ON LINE REJECTION MATERIAL

if we have delar registration & We sale
to 200 qty to 'A'& if part of 200 qry 50 Nos rejected by 'A' then What is to do as per excise procedure & if the A is unregistered or it is not registered to excise what is correct procedure

sale of capital goods

Dear experts

We have one capital goods received in 1989.No record is avialble for this but this is the only memory of senior employees of company Now we wish to transfer it in our sister unit. What is the procedure for transfer it?

Our client is running proprietorship firm and engaged in export of Handmade Carpets. He purchases the yarn from market after that gives to the contractors on jobwork basis and carpets have been prepared.
They are also claiming drawback on export of carpet but there is objection of the department that it is not clear that the client is working as manufacturer or merchant exporter. If it comes under the manufacture activity than they are not registered with Excise Deptt. As in our knowledge there is no excise duty on manufacturing of handmade carpet. ( It is prepared by use of 85% Viscose yarn and 15% of cotton.)
The contention of the department is that since they are not taking the benefit of cenvat credit therefore not eligible for Drawback.
Please guide us the procedure for taking the drawback and DEPB on export of carpet and whether the product is dutiable under the Excise Act or not. In this case , the category of the applicant will be manufacturer or merchant exporter?

Job work valuation

Dear Sir,

Thank you for writing reply.

Sir i have little confusion regarding job work excise duty valuation. Sir just one example to you.

Ex. we have received one order of job work for 100mt @ 10,000/- per mt for job work charges.
The Principle supplier (Who gives order to us) supplied the material in the name of consignee to us. In the raw material invoice was following details

Qty. Rate A.Value Excise Ed. HSE Sub-total Vat Total Invoice
Duty(8%) cess cess
10.000 45000 4,50,000 36000 720 360 487080 19483 506563

In the above example the landing cost is 50656/- per mt. And Excise received on Rs.450000 so input excise assesble value is 45000/- per MT. Now in which value we have to pay as assessble value for Excise duty valuation. It is Rs.50656+10,000 (job work charges)=60656 Or Rs.45000 + 10000 ( Job work charges).

Kindly give me reply in the preventive excise auditing they had told that landing cost plus job work charges were taken as assessble value. Now here our new office manager was not agreed for that. Please clarify the above.

CENVAT ON CAPITAL GOODS.

WE HAVE ERRECT NEW PLANT FOR COST OF 250 CRORES AND PLANT & MACHINERY COST IS AROUND 180CRORE.

WE HAVE AVAILED CENVAT ON CAPITAL GOODS WHAT IS THE WRIGHT PROCEDURE :
EXAMPLE :-
CAPITAL GOODS PURCHASE 180 CRORE @8.24% EXCISE =14.832 CRORE
FIRST YEAR 50% I.E.=7.41 CRORE AVAILED.
NOW AS PER I.TAX RULE IF WE HAVE AVAILED CEVNAT ON CAPITAL GOODS THAN WE HAVE NOT CLAIMING THE DEPRECIATION.
THAN WHAT IS THE WRIGHT PROCEDURE FOR AVAILING BOTH BENEFIT ?

Cenvat credit

Shall we claim cenvat credit on raw materials purchased on credit for manufacturing dutiable goods in the month of purchase? Or whether we should wait till the actual payment for the same has been made as in the case of service tax?

Vinod & Co who had purchased 200 numbers of goods against Form “C” at
a rate of 1190.64/- including Excise 8 %,Cess 2% and H.Ed Cess1%.Due to leakage he had returned 100 number of goods?

registration of excise

dear all members
is the registrationof services tax is mandatory, for availing a cenvat credit of service tax, if the assessee is a manufacturing unit

all the answer what i got is the registration of service tax is mandatory if my out put service is taxable . but clearly if i am a manufacturer than whether this registration is mandatory to me, in case when no output of service is there.
