Cenvat Query

Dear Sir,

If i procure certain Imported goods (For ie. Bearings) from our domestic (First stage dealer) supplier and if he pass on basic excise duty and AED to us.

On the basis of his invoice can we claim Cenvat on basic+ Aed
or can we claim Credit on AED only.

Please clarify

duty drawback

duty drawback is available on
1. import duty paid on the goods which are re-exported
2. excise duty paid on input material.
In case of manufacturer,he can claim the benefit under rule 18 & 19 of central excise rules,2002 but what in case of a trader(retail exporter)?
can he claim duty drawback(in relation to point 2)? if yes then how?

Shortage of Goods


Sir,

We are manufacture of Excisable Goods.When we purchase the goods,as it reaches our factory it is weighed in our weighing scale.It is found that quantity as shown in the invoice and as per our weighment there is shortage of material.

Please clarify the options available;

1.Do we need to reverse the cenvat credit on the basis of our weighment slip as the supplier would not be giving any document for the shortage.
2.whether the shortage can be recovered from the transporter.What are the implications in Excise if the same is recovered from the transporter.Do we neet to raise Debit Note to the transporter mentioning the quantity shortage.

Please suggest any other option.

during the audit of a company i found the company is liable for ssi exemption, company is accross the limit of Rs.1.5 Crore, so i want to know that when he should intimate to A.O
i mean before cross the limit or after cross the limit

CAPITAL GOODS.

Dear Experts,
We have purchased some capital goods before 05 years. Last month we have transfered all the capital goods from Unit-I to Uni-II. We have cleared the capital goods on payment of 100% duty whatever we have taken in Unit-I before 05 years.
Now my question is whether our procedure is correct or wrong.

Cenvat Credit

If a ferro alloy manufacturer, who uses electric arc furnace, takes huge credit on copper bar presumably for manufacture of copper contact clamps for the furnace & if he has no such arrangement for moulding copper bar into contact clamps and gets it done from somewhere else without informing the department, what are the offences? Is the Cenvat credit on copper bar, already availed, is recoverable from him?
