S.s.i exemption

Dear sir,

We are already excise ragistered s.s.i manufacturing unit having turn over of 1.4 crore.
Uptill now we had been charging excise from the very first bill and taking the modvat benefit. Now we want to avail excise exemption benefit. Please answer
1/ Do we need to keep all the ragisters like RG-1 and fill all the forms etc. even after opting for being exempted ?
2/ do we need to file quarterly returns even after availing exemption ?
3/ what will happen to our existing stock of this year ?
4/ from where we can get detailed knowledge about it ?

Clasification of oil from scrap tyre

I am manufacturer. I have plant which I am using for the conversion of scrap tyres and plastic in to fuel oil, carbon black, and steel wire. I don’t know what should be the classification of these products and what should be the excise duty on it.

Kindly help to find out classification and excise duty rate (if any concessional rate of duty prevail than please inform that also)



Technical process flow of product is as under


 This is the batch process systems.

 The waste tyre is fed into the reactor vessel and heated under controlled conditions of temperature and pressure.

 The process will bring about molecular restructuring of the rubber under the pyrolysis process as the result; furnace oil in gaseous form is produced along with other gases.

 These vaporized gases are passed through heat exchanges, where in the furnace oil gas is condensed into liquid form.

 During the process, carbon black is generated.

 The heat exchanger uses coolant water, as the condensing medium and this water is re-circulated.


Process output are :
1) Fuel oil
2) Carboon black
3) Gas
4) Steel Wire

Trade discount under excise invoice

Dear All,

I have a query that one of my supplier issues me bill as under:

Basice Value 90,000.00
Excise Duty @ 5.15 4,635.00
Sub Total 94,635.00
Less:
Trade Disc.@ 10% 9000.00
Invoice Value 85,635.00

I wanna know whether it is right practice or i should avail discount on Rs.94635.00 instead of Rs.90,000.00

Also, Would u please explain me what is Rule 51-A

Cenvat of machine bill (one year old bill)

Sir,

Our Sale will reach at near about 1.40 crore. We are going to registered in Excise.

Please suggest me that can we avail cenvat credit of Imported Machineries, which we purchased in December'2010 and January'2011.

Material return for sez

Dear Experts,

we sale material to SEZ before 1year, but now buyers wants to return some material due to quality reason, We recivied proff of export form buyer & same submitted to excise depatement, now the problem is SEZ authorities of buyers demands that we pay duties first than they return material,
Is there is any procedure that they return material without pay any duty when we resale this material in domestic market than we pay duty. Pls suggest

I would like to know the complete details of Taxation Part.



Project Details,



We get the Damaged material from overseas Australia, have to do some job work like welding, painting, packing and no manufacture or production is involved.



We have to re send the Container Repaired material back to Port of Origin.



So, the parties involved are Overseas Company and the Company floated in India.



Now, I would like to know



1. Documents required at Customs, means like invoice etc. - So, Customs Duty

2. Any Excise duty
