When your business is nearing the threshold of crossing 1.5 crore in sales, it becomes mandatory to register under Central Excise. Hereโs a step-by-step guide on how to handle the stock of raw materials and finished goods and how to claim Cenvat credit, along with the necessary records for compliance with the Excise Department:
### 1. Registration and Compliance Requirements:
1. **Online Registration**: Since you've already registered online with the Excise Department, ensure all details provided are accurate and up-to-date.
2. **Threshold Crossing**: Once your sales cross 1.5 crore, ensure timely compliance with Excise regulations, including filing of returns and payment of duty.
### 2. Handling Stock of Raw Materials and Finished Goods:
1. **Stock Taking**: Conduct a physical stock take of all raw materials and finished goods on the date you are required to register under Central Excise.
2. **Valuation**: Determine the value of each item of stock, segregating them into raw materials and finished goods categories.
3. **Stock Transfer to Excise Control**: Upon registration, inform the Excise Department about the stock of raw materials and finished goods on hand. Typically, the Excise Department will conduct a verification and assessment of the stock.
### 3. Claiming Cenvat Credit:
1. **Eligibility**: You can claim Cenvat credit on inputs used for manufacturing of excisable goods and on capital goods used for the same purpose.
2. **Procedure**: Submit a declaration to the Excise Department detailing the stock of raw materials and finished goods. This will form the basis for claiming Cenvat credit on inputs and capital goods.
3. **Records and Documentation**: Maintain the following mandatory records: - **Invoice Records**: Purchase invoices for raw materials and capital goods showing payment of excise duty. - **Production Records**: Records of production showing consumption of inputs. - **Stock Records**: Stock register showing opening balance, receipts, issues, and closing balance of raw materials and finished goods. - **Cenvat Register**: Maintain a separate register to record the utilization of Cenvat credit.
### 4. Compliance with Excise Department:
1. **Regular Returns**: File monthly or quarterly returns with the Excise Department, detailing production, clearance of goods, and payment of duty.
2. **Inspections**: Be prepared for inspections by Excise officers to verify compliance with Excise rules and regulations.
### Conclusion:
As you approach the threshold for Central Excise registration, ensure all necessary steps are taken to comply with Excise regulations. Proper documentation and maintaining accurate records are essential for smooth operations and claiming Cenvat credit. Engage with a tax consultant or Excise expert if needed to navigate through the registration and compliance process effectively.
