We are manufacture of automobile part and registered in excise, now we want to start trading activity please tell me we have to take new registration for trading purpose or not.
If yes, after the registration what types of documents are required for maintaining of record?

We have a dealer's registration premises wherein we get imported goods from third parties, local manufactured goods from third parties and also manufactured goods from our own factories.
The new Deputy commissioner is objecting to this saying the trading items Third party items) and manufactured goods cannot be transacted in the same registration.
Please give your valuable opinion on this objection, with legal provisions.

I have a query regarding excise ..
There is a granite manufacturing unit in the name of XYZ pvt ltd . Now the manufacture wants to start the production of some other article (not granites ) in the same premises but as a separate unit.
Now in terms of excise exemption , do we need to consider both the products or can we claim unit wise exemption ??

kindly clarify whether in first stage dealer invoice mention of mfg name is complusory as per law.
during excise audit, audit people telling it is complsory as per law. but as rule 11(2), it does not mention about it.

My client had mft plant in tamil nadu and Depot/godown in Karnataka.
they are doing branch trf of mfd good to karnatka and invoice the product to ultimate customer as first stage Dealer.
My query is as per rule 11, mention of mfger name is compulsory or not.
I need notification regarding compulsory content of first stage dealer.
During excise audit of our customer,audior disallowed CENVAT Credit of first stage dealer, which does not mention mfg name.( invoice is as per tally format)

Today we have observed that the gross sales value updated in ER-4 is not matching with trial balance.
There are 33 Lacs freight amount included in gross sales value.

Can any one help me to give the knowledge about the central excise turn-over limit also need information how sales under excise are documented. For Example - If sales turn over under excise is 2crores and in that if sales against H form is 50Lakh (through third party export) so do i still fall under / over excise limit.

There is a publishing house which publishes spiritual books and DVDs.
Books are printed from various printers.The publishing house gives the content. Two mode of printing was used. 1. Publisher supply paper and printer prints the book. 2. Printer uses his own paper and print the book.
Dvds are replicated with vendors who charge excise duty with abatement which we pay the vendors.
Now, the observation is as follows:
Being a manufacturer of excisable goods which are chargeable to nil rate of excise duty or are falling under head where rate is Blank. Further, as per Rule 9(2) (i), persons who manufacturer excisable goods which are chargeable to nil rate of excise duty are fully exempted from the duty by a notification subject to the declaration to be made in specified Form.
Hence, the publisher was asked to register under excise or submit the declaration form.
Now the point of contention is as follows:
The point of taxation arises only on the account of manufacture. As per Excise Act, the job-worker (printer) is the manufacturer under both the circumstances. Deemed manufacturer is not arising as price is the sole-consideration for awarding the order and there is no principal to principal basis.
Hence, the publisher is not a manufacturer and hence need not register under excise or file a declaration to such effect.
Pls clarify.
