Dear All
We are a manufacturer of Excisable goods of Iron and Steel and are claiming CENVAT on inputs (Raw materials, Consumables etc.).
Also we are doing Job Work for some parties (Principals), who supply only Raw Material (Iron and Steel) to us.
For Job Work, we use some Consumables procured by us and not supplied by the Principal.
Nature of Consumables is in the form of Acid, Lubricants, Packaging Materials etc.
These Consumables are Excisable items.
Rule 6(3) of CENVAT Credit Rules says that separate records should be maintained for the inputs used in manufacture of Excisable Goods, and the inputs used in Job Work; and that CENVAT should not be claimed on the inputs used for Job Work.
This means loss of CENVAT.
Now the query is – Can we (job worker) take credit of CENVAT on the inputs (Consumable items) used for Job Work; and pass on the same to the Principal in the form of Duty in the Job Charges Invoices.
Please comment if this will be a right procedure or not.

I have queries regarding availment and utilization of Cenvat Credit:
Q.1. factory was availing the benefit of any exemption Notification and due to this no excise duty were payable on Finished Products, but now exemption has been withdrawn and it starts payment of duty. Whether Cenvat Credit can be availed on capital Goods if those were purchased when factory was availing the benefit of exemption? if yes, in how much old capital goods we can avail Cenvat Credit?
Q.2. Whether Cenvat credit can be availed on Capital goods if such capital goods was using for manufacturing Duitable and Exempted Goods?if yes, in how much old capital goods we can avail Cenvat Credit?

My client is commercial vehicle mfg. in India, registered for new TRADING PALNT for their Export operations. Before that they have planed for Export warehouse and due to some limitations(even direct import to export warehouse,subcontracting is not allowed)they have moved to new TRADING PLANT.
Now I would like to know the impact of Excise Transactions.
1.can we directly import goods to trading plant and export?
2.can we take credit on exportable goods importing to trading plant?
3.what are the forms and registers need to update?
4.is it allows transfer of aggregates from manufacturing plant to trading plant?
5.Can we procure packing material directly from suppliers, what are the tax impacts?
is the CT-2 FORM applicable ?
Please suggest on these doubts and can any one through some more info regarding trading plant for exports.
