CENVAT credit on capital goods.

some capital goods purchased on 01-07-2007. The excise duty paid thereon was Rs. 200000.00
As per Rule 4(2) of CENVAT Credit Rules, 2004, CENVAT Credit on capital goods may be taken in the financial year in which capital goods received to the extent 50% of excise duty paid. The balance 50% can be taken in any of subsequent Financial Years in which goods are in possession.

> So, Rs. 100000.00 can be taken in the month of july-2007 (i.e. Financial year 2007-08)

> let these capital goods scrapped on 30-06-2010.

Q: in which Financial year and in which month, balance amoun of the CENVAT credit may be taken?

PASSING OF MODVAT

we are buying a product but seller is not excise registered hence which we are not getting modvat benefit however for the same product our buyer(to whom we are selling ) wants us to pass MODVAT benefit. Please advice can we pass this, we are registered in excise as a trader.

Excise Invoiceing

We have manufacturing unit(Fabrication of M.S. Shuttering) in haryana please suggest me the following.

A party ordered us some shuttering & they will provide us raw material. When material arrived we booked the material in purchase, avail cenvat credit & vat. Party also booked the same material in his account. Now they told u will raiesed the job work invoice. what shall we do & what is the proceeger to billing.

Shifting of exempted unit

Dear Freinds,

Pls provide the solution of my below mentioned querry:

We have a unit of footwear in Paonta sahib, distt. Sirmaour and we are exempt under Notification no. 49-50/2003 dt. 10-06-2003 now we want to shift the unit at another place in same distt.whether we can shift the same or not. if yes pls provide the notification/ section/ case etc. in support.

EXPORT

In case export is made to Nepal/Bhutan and payment is received in foreign currency say dollar will it qualify for EPCG (i.e. export obligation under EPCG license).

Bill of Entry transfer

Dear All

We received an imported material at Chennai port but the Bill of entry is on our plant at Gujarat , but the material is supposed to be cleared at Chennai plant(not Gujarat). what is the procedure to unload at chennai plant itself, and how to take cenvat credit of cvd amount. kindly help

excise duty

dear experts
we have imported a machine and paid custom duty for that . i want to know that either that excise duty can be take as excise credit and again either yes up to what extent in this year ,

Cenvat Credit on Capital Goods

Dear Experts,
As per Rule 4(2)(a) of Cenvat Credit Rules 2004:
"The CENVAT credit in respect of capital goods received in a factory or in the premises of the provider of output service at any point of time in a given financial year shall be taken only for an amount not exceeding 50% of the duty PAID on such capital goods in the same financial year"

Cenvat Credit of 50% in the year of receipt and balance in subsequent year(s) -- is a known concept.

Query: Does the use of the word "paid" mean that credit will be allowed only on payment of duty. If credit is allowed even without payment then why has the word "paid" been used?

it is necessary to show the keyman insurance policy premium in COST SHEET AS PER CAS-4 ?
