19 October 2010 Dear Freinds,

Pls provide the solution of my below mentioned querry:

We have a unit of footwear in Paonta sahib, distt. Sirmaour and we are exempt under Notification no. 49-50/2003 dt. 10-06-2003 now we want to shift the unit at another place in same distt.whether we can shift the same or not. if yes pls provide the notification/ section/ case etc. in support.

23 October 2010 Shifting of factory is allowed.
Ideally apply for registration in new premises, intimate the dept of reason for seeking registration and fact that you were already availing the exemption.
Once registration obtained. seek permission to shift all the capital goods, stocks and ensure that the quantitative records after shifting are offerred for scrutiny. May not be scrutinised.

but we have no registration as not required under the exemption under notification no 49/2003 and 50/2003.
Pls provide the notification/case law/ section.
