Cst on freight

Dear Sirs,

I am working as AM(Purchase).

Please clarify Below :

One of our supplier raised an invoice as under :

Basic cost(X) + ED(Y) + Freight(Z) + CST on(X+Y+Z).

Is this correct procedure?

How can they charge CST on Freight?

If freight includes in Basic price but not shown separately in invoice , then can we calculate ED on basic price?(i.e includes fright).


We have Modvat Benefit.

Please clarify.

Dear Sir/Ma'am
i have a query related to SSI exemption

As per notification no. 08/2003 we are entitled to SSI exemption.
now one problem has occurred while calculating 150 lakhs limit.we are issuing invoice. the format of the same is as follows :
10000 bricks @ 3.85 = 38500
Add : transport exps
(10000 bricks @ 0.65) = 6500
Total amount = 45000
now the problem is that whether this transport amount would be includible or not for the calculation of 150 lakhs limit.

A excise duty of 1% was imposed on a total of 130 products through notification no. 01/2011 01.03.2011. For the products that attracted nil rate of duty a statutory tariff rate was fixed at 5% whereas for all the remaining products a general effective rate of 5% through notification no. 02/2011-CE dated 01.03.2011 was introduced. now my question is can the products not covered under Not. no. 02/2011-CE pay duty @5% as given in tariff (Statutory rate), if so will they be able to avail cenvat credit facility?

Cenvat credit

We are producing goods & paying Excise Duty. For expansion of business new plant & machinery was purchased which is not put to use till date. Can we utilize 50% cenvat credit paid on the same for setting off our current liability in the year of purchase or we have to wait till the date of use of machinery?

Excise returns

Hi

Based on what rules, we have to file excise returns ER-5, and ER-7.

If it is not based on rules, what it makes to file us these returns.

General Penalty will be applicable in respect of non compliance of filing these returns or not.

Suppose a company X is having the following business.
It extracts Ore(exempted) from Mines and does the following thing:
A. Process it and make excisable goods at its own factories which are away from Mines.
B. Sales some part of it.
C. COnvert to Excisable goods through EPA's.

The mining Job is carried out by a contractor. Whether the company can take the credit of service tax paid on excavation?

Cenvat credit utilization

To Any one pls answer,

We are the large importer of Aluminium scrap we paid 12% Basic duty & 4% additional duty on imported material. & Manufacture Aluminium ingot which sale in Indian market at very low price because of international market competition. due to this we are unable to utilized full duty credit to payment of duty which resulted accumulation of cenvat credit in large volume. is there any way to utilized or refund this duty?
