Whether WHT/TDS is applicable for Software purchase from overseas seller

IF ITS A CASE OF OUTRIGHT SALE THEN TDS WILL APPLY ONLY IF THE NON-RESIDENT HAS ANY BUSINESS CONNECTION OR PE IN INDIA.
IF ITS A CASE OF RIGHT TO USE SOFTWARE THEN THERE IS A LOT OF CONTOVERSY.
