What is penalty for not filing service tax return?

15 December 2013 Hi,

I took by service tax no. by a fraud ca. He registered my service tax no. by his email id and phone no.

I got it registered in 2010 as yet I could not file our service tax return but i contact another ca he paid my service tax amount what i charged from my client. but now he is asking user id and password but now that fraud CA is not responding me.

please help what should i do?

He has registered my service tax no. by his own email id and password.

Please suggest what to do?

16 December 2013 You may write them (Service tax) that you want to reset your contact details as well (your consultant must be knowing this)

My consultant CA ji is a 100% fraud he is not picking up my call and not responding on email and is untraceable.

16 December 2013 Dear friend,

You can write to your range officer with the registration number and appraise him of the factual position, and your email ID. He will be able to tell you about your user ID and can update the mail id in the system and thereafter your will receive the password in your new mail id. Then you will be able to access the aces web site and file the returns. Penalty for non-filing of returns can be upto Rs.20000/(maximum)

03 August 2025 Absolutely! Hereโ€™s what you need to know about receiving payments through PayPal from outside India and your tax liability:

Tax Liability on Receiving Payments from Abroad via PayPal
Nature of Payment:

First, identify the nature of the payment:

Is it payment for services rendered?

Sale of goods?

Gift, donation, or other?

Income Tax:

If the payment is income (like payment for freelancing, consulting, business services, or sale of goods), it is taxable in India under your income tax return.

You must report it as income in the relevant head (e.g., Business Income, Professional Income).

You are liable to pay Income Tax as per your applicable slab rates.

Maintain proper invoices and records of transactions.

GST (Goods and Services Tax):

If you are a registered person under GST and providing services or goods to clients outside India, it is considered Export of Services/Goods.

Export of services/goods is zero-rated supply under GST, meaning GST rate is 0%.

You can claim input tax credit on GST paid on inputs used for export.

You must comply with GST rules for exports, such as filing relevant GST returns and maintaining documentation.

Foreign Exchange Regulations:

Payments received via PayPal must be repatriated through authorized channels and you must comply with FEMA (Foreign Exchange Management Act) regulations.

Maintain transaction proofs to show the source and nature of foreign income.

TDS (Tax Deducted at Source):

Usually, no TDS is deducted on incoming payments from abroad, but if you are making payments outside India, you may need to deduct TDS as per laws.
