23 December 2013 I have a proprietorship company and I have not filed service tax returns as the turnover is below the prescribed limit. do i need to surrender the service tax registration.

Also, some of my corporate customer has deducted the TDS and deposited the same and send form 16A. what should i do.

23 December 2013 1. you can surrender if you wish to.,

2. you dont have to do anything except for filing the income tax return and claiming credit for the taxes deducted.

23 December 2013 Dear Nikhilji,

What if do not surrender the service tax. is it better to file the return quaterly without paying the tax.

We do not have the audited accounts so how do we verify to the service tax department that there is no service tax pending.

Can i take professional services from one of the experts here to get personal advice on this issue.


23 December 2013 1. it is not required to file returns if no taxable services were offered. However, yes you can file nil returns.

2. well you must be atleast having the invoices raised for the services offered by you. Those invoices alongwith the bank account statements shall be sufficient to prove your turnover.
