06 May 2014 Sir,

If possible please provide any useful link.

02 August 2025 If you purchase goods in Delhi with 1% VAT and transfer them to Uttar Pradesh (U.P.) as stock transfer, the ability to adjust VAT depends on the specific circumstances and compliance with relevant tax laws.

### Key Considerations:

1. **Delhi VAT Input Tax Credit:**

* Under the Delhi Value Added Tax (DVAT) Act, input tax credit is generally available on purchases made within Delhi. However, restrictions apply when goods are transferred outside Delhi.
* Section 9(6) of the DVAT Act stipulates that if goods purchased in Delhi are transferred outside the state (otherwise than by way of sale), a reduction in input tax credit is required. The prescribed percentage for such reduction is 2% of the total input tax credit available for stock transfers. ([TaxGuru][1])

2. **U.P. VAT Input Tax Credit:**

* In U.P., input tax credit is available on purchases made within the state, provided the goods are used for taxable sales within U.P.
* However, if goods are transferred from Delhi to U.P., U.P. VAT authorities may not allow input tax credit on the VAT paid in Delhi. This is because the purchase was made outside U.P., and U.P. VAT law typically does not permit credit for taxes paid in other states. ([mgaonline.net][2])

3. **Inter-State Stock Transfer:**

* Stock transfer between branches located in different states is generally not considered a sale and, therefore, may not attract VAT. However, the input tax credit implications can vary.
* Some states require a reversal of input tax credit when goods are transferred outside the state, as mentioned in Section 9(6) of the DVAT Act. ([TaxGuru][1])

### Practical Implications:

* **Delhi to U.P. Transfer:**

* You may need to reverse 2% of the input tax credit claimed in Delhi due to the inter-state transfer.
* U.P. VAT authorities may not allow you to claim input tax credit on the VAT paid in Delhi.

* **U.P. Branch Operations:**

* If the U.P. branch purchases goods locally within U.P., it can claim input tax credit on those purchases, provided the goods are used for taxable sales within U.P.
* Ensure proper documentation and compliance with U.P. VAT laws to avail of the input tax credit.([TaxGuru][1])

### Recommendations:

* **Maintain Separate Records:**

* Keep detailed records of all inter-state transfers, including invoices and stock transfer documents, to substantiate your claims and comply with tax regulations.

* **Consult Tax Professionals:**

* Given the complexities of inter-state VAT laws, it is advisable to consult with tax professionals or legal experts familiar with both Delhi and U.P. VAT regulations to ensure compliance and optimize tax benefits.

* **Review State-Specific Regulations:**

* Stay updated with any amendments or notifications issued by the VAT authorities in both Delhi and U.P., as tax laws and regulations can change over time.

By adhering to these guidelines and seeking professional advice, you can navigate the complexities of VAT adjustments related to inter-state stock transfers and ensure compliance with applicable tax laws.
