an appeal before ITAT was filed against order u/s 263 questioning the jurisdiction of CIT.
Assessing Officer has passed an order giving effect to CIT's direction while the appeal was pendin before ITAT
Subsequently, ITAT has passed an order in favor of assessee.
Is assessing officer's order valid? or not?

First of all when appeal was pending before ITAT assessing officer should not have passed order acting upon CIT's direction. Now that he has passed the order the same is nullified in view of ITAT's ruling in favour of assessee.
