1. You can transfer the land by getting registered the land in the name of your HUF at a price which is not less than the stamp duty valuation. 2. If the land is in urban area, then you (Individual) will be liable for capital gains tax.

Hey! To transfer **agricultural land** from your individual name to your **HUF (Hindu Undivided Family)**, here’s what you need to know and do:
---
### Procedure for Transfer of Agricultural Land to HUF:
1. **Ownership & Capacity**: Since you own the land individually, and you want to transfer it to the HUF (which is a separate entity for legal and tax purposes), it is considered a transfer of immovable property.
2. **Transfer Deed**: You must execute a **registered gift deed or sale deed** in favor of the HUF.
* Most common way is a **gift deed** if you are not charging consideration (sale price). * If sale deed is used, then a proper sale price (fair market value or stamp duty value) must be declared.
3. **Registration**: The deed must be **registered** at the local Sub-Registrar’s office.
* Stamp duty and registration fees are payable as per the state laws. * The transfer will be effective only after registration.
4. **Stamp Duty**: Stamp duty will be charged based on the **market value** or the **consideration amount**, whichever is higher. It varies from state to state.
5. **Mutation**: After registration, apply for **mutation** of the land records to change the ownership in the revenue records from individual to HUF.
---
### Tax Implications / Obligations:
* **Capital Gains Tax**: Transferring land to HUF is considered a **transfer** under Income Tax Act, so you may be liable to pay **capital gains tax** (short-term or long-term, depending on the holding period).
* If the land is agricultural land in a rural area, it might be exempt from capital gains tax. * If the land falls under “urban” area or is considered capital asset, capital gains tax applies.
* **Gift Tax**: Gift from an individual to HUF is **exempt from gift tax** under Indian tax laws.

### Summary:
| Step | Description | | -------------- | ----------------------------------------------- | | Execute deed | Gift deed or Sale deed in favor of HUF | | Register deed | At Sub-Registrar office with stamp duty | | Pay stamp duty | As per state govt rules | | Mutation | Update revenue records to reflect HUF ownership | | Tax liability | Capital gains tax on transfer (if applicable) |
