03 October 2013 Sir/Ma'am,
My principal has refused to give me a transfer. So, I had to lie about my health so that I could get a transfer. I am not at all comfortable working in this atmosphere and I always feel very stressed and mentally tired here. Now, he is aware that I have lied and he is compelling me to give in writing that I lied and he will submit this to the institute and ask for approval. What should I do??
I am totally puzzled. Its my 1st year of articleship.

03 October 2013 It is better you ask for forgiveness from your ca as if he doesnt sign on form 109 then u cannot take a valid transfer and even icai cannot do anything without your ca's sign.

03 October 2013 ask your parents to meet him and solve the issue here itself as it will otherwise spoil ur career.

03 October 2013 You can take transfer without any redtrictiom in the 1st year of articleship..

However, the consent of your principal is required,
ICAI will not interfere in any disputes between Principal and the Articled Assistant...

1. Whenever he is in happy mood, put some polite word and convince him.

2. Plz., tell him that Sir, I learned lot of things from you, unfortunately, not able to work with you.

3. Worst and Worst case, if he refuse to give, you file one more new Article Form 109 with other CA.

4. So many people faces this problem, but Institute is mum in this regard.

5. Write a letter to the President. Final stage.

6. When we join as a Article, it is not a bound labour.

7. Before, joing other CA, take the help of others and join, whenever the problem persist, they will come forward to you.

03 October 2013 YES, I can understand your situation as i faced such situation on my transfer of articleship,,however i didnt let this so much serious

if you give in writing he will may tell you that he will complain to icai on basis of your letter--

however if there is no choice you can give letter to your boss as he requested,,,and as you have a reason for your lie it can be convincible

04 October 2013 dnt give anything in writing.. dnt fear no one has power except ur parents and god to ruin anyones life.. try to convince him if he doesn't then stop going and write letter to icai noida.. be ready for facing anything in life.. try to get a fake transfer letter from ur parents office and send that to icai noida..
