i have query related to tds on mess...during the audit i found that one of the limited company not deducted tds on mess contract..i have raised objection...then there accountant give me excuse that mess is fall in restaurant category..and tds is not applicable...on restaurant...pls suggest me is this right...mess can be included in restaurant category>????

If the Accountant is telling , they are making the payment as resturent, you must verify his statement. Because TDS is not applicable , if payment is relaesed against Resturent bills.

ya i know that tds is not applicable on restaurant...but my question is how can mess included in restaurant category....
