19 November 2010 Dear Expert's,
Mr.X has not filed income tax return for the f.Y. 2008-09, but his TDS is Rs. 2500 for that year? & for the FY 09-10 his income is below 1.6 lac.

My query is, he can file the return? to claim refund
pls clarify

19 November 2010 No he can not claim TDS as refund in his return for Fy 2009-10.

19 November 2010 My query is can he file ITR-1 for the FY 08-09 & FY 09-10. In both the years his income is below 1.6L

19 November 2010 He can file return for Fy 09-10 only.
Return of Fy 08-09 now will attract penalty of5000/-(Max). But since your income was below Rs 1.6 Lacs penalty may not be levied on you.
