TDS on transporters

W.e.f. 01.10.2009, from the bills of transporters TDS is not applicable if they quote valid PAN.
In our company, we do import goods from germany and china.We get the separate bills form freight from china to Indian port and separate bill for clearing charges etc. from our clearing agent.
Should we not deduct the Tax from freight bill or we should continue the present practice of deducting tax?

its shipping agency not transporter kindly deduct TDs as applicable.but if this is none regidence co. or his authorize agant then no tds applicable. if you need i will give Incometax clearifiaction copy.
