Tds on rent

Sir, My doubt is if RENT paid Rs.2,16,000.00 per year . TDS to be PAID ON 2,16,000/- OR RS.216000-180000= 36000/- ON 36000/- .
Pls inform ME..

31 January 2012 Income tax has to be deducted on Rs,2,16,000.00 subject to other conditions of section 194 I.

31 January 2012 The section says that tax is to be deducted on whole amount of rent if the rent paid or payable exceeds Rs 180000. It is not like that there is exemption from deduction of tax till Rs 180000.
If the total rent paid or payable is less than or equal to Rs 180000 then no tax is to be deducted but when rent paid or payable exceeds this limit then tds is to be made on whole amount.
In your case as the rent paid or payalbe is s 216000 then tax should be deducted on the same and not on the amount after deducting Rs 180000
