31 July 2008 HUF has given loan to a company. when the company issues the TDS certificate PAN number used of Karta and name mentioned is of HUF. How to deal in such situation. Can TDS certificate be modified ELSE WHAT IS REMEDY?

31 July 2008 TDS has to be in the PAN of HUF.

31 July 2008 since mistake has happened now what to do?

31 July 2008 You have to ask the issuer to correct the certificate.

31 July 2008 You shall not be able to claim the TDS on the basis of TDS Certificate. What you can do is, either ask the company to modify the TDS Certificate. In this case, the company will have to file the revised TDS return and then only it will issue you a fresh certificate. or another solution is that you just claim the TDS in ITR. When asked, file all the documentary proofs alongwith an application in this regard to the ITO. If he will be satisfied, then probably he can allow you the TDS in return of HUF, but chances are very low in this case.
