31 July 2010 MY QUERY WAS THAT THE EMPLOYER COMMITTED UNINTENTIONALLY MISTAKE WHILE CALCULATING HRA OF SOME EMPLOYEES THIS RESULTED IN SHORT PAYMENT OF TDS FROM EMPLOYEES.
HOWEVER AFTER KNOWING IT THE EMPLOYEES DEPOSITED THEIR CORRECT TAX AFTER CALCULATION THROUGH SELF ASSESSMENT.
SO HERE COMM. OF IT(TDS)RAISED DEMAND WITH INTEREST.
SO, PLEASE OFFER YOUR CORRECT VIEWS IN THIS REGARD.

31 July 2010 Legally speaking, deduction & payment of correct TDS is employer's responsibility & their is no escape from that.

So, it will depend upon the sole discretion of the assessing Officer to consider the genuine feature of your case & accordingly he may waive this demand.
