I have to make payment to a contractor for making road, so i would like to know whether its come under Works Contract Act or TDS, and how much & how to deduct TDS

TDS under 194C.
Rate 1 % if the contractor is individual or HUF
Rate @ 2 % if its a company / firm / co-op soc / local authority
