I was an employee of a construction company. Company has deducted TDS from my Salary in last financial year. I found that TDS has not shown in 26AS. I am continously following up regarding my TDS amount. Company told me that they has been financially suffering, they are not able to deposit the TDS amount. I am having all salary slip & other details. Please suggest me how I will proceed for legal action against company.

you should file your return and claim TDS
on the basis of TDS certificate
if the same has not been issued you can write a letter to the TDS department about the same stating about your TDS deduction

You can claim in return. definitely a notice will come.
as per my advice if you want to do this then you can complain in income tax department also. you can show them salary slips. they will take action and they can check the balance sheet also. because some time these companies manipulate the balance sheet and don't show in statutory liability.
