11 October 2008 Whether sheer volume of transactions in shares & securities(delivery based) is the determining factor for treating the income under Capital Gains or Income from Business ?

11 October 2008 There is no hard and fast rules in this regard. One criterion is periodicity and volume of the transaction.

13 October 2008 It is the intention of the parties entering into such trades and then the volume of trades which may be a parameter for classification as an adventure in the nature of trade or not.
