Taxability of Foreign technical Consultancy

On e Indian company has imported equipment and also in the order erection supervision is given to the foreign vendor chargeable on Per day basis whether it is taxable as foreign technical services or not

The same shall be chargeable as Fee for Technical Services,but also kindly check the stay of foreign vendor personnel as it may give rise to PE and than the sum payable on account of erection and supervision shall be taxable @40% on NET INCOME BASIS.
