Dear Sir,

Suppose this is a Security Bill.
Amount Rs 21000
Service Tax Rs 3000
Total Rs 24000
How to deduct TDS u/s 194(c).Is it tds is to be deducted on Rs 21000 or Rs24000.Here Service Tax element is taken in to consideration or not?

Regards

Answer: Actually It Should Be Deducted On 21000/-
But Many People Opine That It SHould On 24000/-.
Anyways If U Deduct On 21000/- It Won't Tantamount to Any Non-Followance Of Any Law.

01 September 2008 C.B.D.T HAS CLARIFIED THAT IN THE SAID CASE TAX IS TO BE DEDUCTED ON Rs.24000/-AND NOT ON Rs.21000/-

01 September 2008 I agree with Sri Chkrapani. You may also like to visit http://www.taxworry.com/2007/03/tds-on-gross-amount-including-service.html

02 September 2008 But If Someones Deducts on 21000/-
There is No Problem At All.

02 September 2008 Tds is on total liability that inclusive of Service Tax.Service tax must be included in calculatiing TDS u/s 194C.

20 April 2010 Yes. TDS in case of 194C is deductible even on Service Tax elements.
