05 January 2009 Our comapny got a bill from a service provider who has not charged service tax.
are we liable to pay service tax on that?

05 January 2009 If service provider has not charged you are under no obligation to pay the service tax.

05 January 2009 for service provider the charges will be inclusive of service tax so no extra service tax to b paid

05 January 2009 May be an exception is there in cases where service receiver is Company and the like and nature of service is goods transport

1. Consultancy
2. Erection & Commisioning
3. Sponsership
4. Import of service
5. Transport

06 January 2009 As per my view, In case of consultancy service, Erection and commissioning service the service provider is liable to pay the service tax. But in case of sponsorship service, Import of service, Goods transport service, the service receiver is liable to pay the service tax subject to fulfillment of certain conditions
