Service tax on transportation of workers

16 February 2013 We have hired a bus for tranporting workers to our factory. Every month he is sumbitting the bill which comes to Rs.90000/-. Pl let me know whether service tax is applicable but we have deducted TDS

17 February 2013 Yes. Service Tax is applicable.
If Service Provider is other than corporate & Service Receiver is Corporate reverse charge is also applicable. on 40% of Invoice value you have to pay service tax as service receiver.
Whatever you pay under reverse charge is not cenvetable as it is specifically excluded under the definition of Input Service given under 2(l) of CCR 2004.
