This query is : Resolved

20 March 2016 I have one Query?I have made payment of luxury tax to the government on the scheme of 50 payment to the govt for luxury tax on the MRP Base. If my sale of services of providing the room is higher and I have made payment 50 luxury tax.But actual liability of Tax is more. For e.g. Actual wants to pay luxury tax 10000 and I have made payment of 8000. So can I have to pay service tax on the excess of Rs.2000 surplus which is not paid. Can this is chargeable to service tax???

20 March 2016 Here 50 means 50 percentage

20 March 2016 50 means 50 percentage

24 July 2025 Regarding your query on service tax and luxury tax:

* Luxury tax is a state tax levied on the sale or provision of luxury goods/services such as hotel rooms.
* Service tax (now subsumed under GST, but relevant for your historical query) was levied by the central government on taxable services, including hotel accommodation above certain tariffs.

### Your specific situation:

* You have paid luxury tax based on 50% of MRP (assuming this means 50% of the tariff is considered for luxury tax).
* Your actual liability (luxury tax) is higher than what you paid (e.g., actual Rs. 10,000 but you paid Rs. 8,000).
* Now you ask whether the unpaid Rs. 2,000 surplus will be chargeable to **service tax**.

### Answer:

* **Luxury tax and service tax are different taxes levied by different authorities (state vs central).**
* Service tax is calculated on the value of taxable services, such as hotel room rent exceeding the exemption limit.
* **You cannot treat unpaid luxury tax as a service tax liability.** They are separate taxes.
* If you underpaid luxury tax, the state government may recover the balance with applicable penalties and interest.
* Service tax liability is **independent** and based on the gross value of services provided and is not linked to the luxury tax amount paid or unpaid.
* So, the Rs. 2,000 unpaid luxury tax **cannot be charged as service tax.**

If you want, I can also help clarify how service tax on hotel accommodation was computed before GST. Would you like that?
