12 January 2013 Company having Solvent Extraction Plant & Refinery is manufacturing some exciseable products.
Company manufacture Acid Oil Sludge which is exciseable. Some Qty of this Acid Oil Sludge is sold and some is self consumed in production of Acid Oil.

Final Product Acid Oil is excisable but in process of Acid Oil Production some qty of acid oil sludge lost.

Ex.:
Acid Oil Sludge consumed : 10 MT
Acid Oil manufactured : 2 MT

What procedure is to be followed by company for self consumption.

12 January 2013 As long as the final product is excisable goods there is nothing to be done.
On the sludge which is liable pay duty on transaction value.

On self consumption there is liability only if the final product is not liable to duty as otherwise it is exempted under Not 67/95.
If final product is not liable the liability would arise for self consumption and duty would be payable on COP + 10 % subject to 150 lakhs basic exemptions.
