AFTER NAME APPROVAL WHICH FORM IS TO FILED FOR SECTION 8 COMPANY

Next step after approval of name is to get approval from Regional Director of MCA by filing Form RD-1 with Registrar of Companies (RoC) for licence for a Section 8 Company. During filing of Form RD-1 the following document will be required:
a. Form INC-12 application for grant of license under Section 8 of Companies Act, 2013
b.MOA in From INC-13 prepared in accordance to Rule 19(2) of Companies (Incorporation) Rules, 2014
c. AOA
d. Declaration by CA or CS or Advocate or Cost Accountant in Form INC-14 prepared in accordance to Section 7 (1)(b) and rule 19 (3)(b) that for formation of Section 8 Company, MOA and AOA have been prepared in conformity with Section 8 of the Companies Act, 2013
e. Statements of Assets and Liabilities
After getting the Licence, the MOA and AOA are sent for MCA Approval.
Form INC-7 for application for incorporation of company, along with INC-22 for notice of situation of registered office and DIR-12 for giving particulars of directors appointed and key managerial personnel are filed online.
The MCA will scrutinize and verify the eForms. If they are found to be in order and are duly approved, a digitally signed certificate of incorporation is emailed to directors.
