Filing your Service Tax return for April to August without paying the Service Tax for September can cause issues. Here’s why:
Service Tax returns must be filed only after the tax for the period is paid.
Filing the return while the tax for September is unpaid is technically incorrect and may invite penalties or notices from the department.
Generally, the due date for monthly Service Tax payment is the 5th or 6th of the next month, and the return filing due date is mid-month after the tax payment (like 25th or so).
What you should do: Pay the Service Tax for September first (even if late, with applicable interest).
Then file the return for April to September (including September’s tax).
Risk if you file without payment: Return may be rejected or flagged for non-payment.
You may attract interest and penalties for delayed payment.
Future compliances may be affected (like input credit claims).
So, it’s safer to pay first, then file the return.
