Return of excisable goods

This query is : Resolved

25 September 2012 Dear Sir,

we(buyer) have returned the some excisable goods ( due to excess qty) to the manufacturer, who has already paid the excise duty at the time when goods were sold to us.
Now while returning the goods, the manufacturer is asking us to issue excise invoice to them, while we fall under SSI limit.
Is this excise invoice required to issue, while we fall under SSI?
If we issue excise invoice, we have to pay excise duty on the same, but as being SSI we are not taking Cenvat Credit?

Pls guide me how to handle this situation, so that there shall be no liability on us to pay excise duty while returning the goods?

11 October 2012 you can give debit note in regards to that particular excise invoice. They can take the cenvat credit on the excess returned goods.
