17 February 2012 My father has not filed his IT Returns since AY 06-07. He is a salaried person. Tax has been deducted at source by his employer. Can i file all the returns in this AY?? What will be the penalties levied (if any) ?? What should he do in such a situation? Please advise...

18 February 2012 He was liable to file his return. The penalty for non filing of return is Rs. 5000/-. It may or may not be levied.

You must file returns for AY 2010-11 and AY 2011-12 without further delay.

18 February 2012 Thank you sir.. What about the previous returns? Should I file them as well? Is the penalty of Rs 5000 levied on a whole or on a single return?

Filing Past Returns:
It’s best to file all pending returns (from AY 06-07 onward). Though the department may not insist on very old returns, filing them helps clear records and claim any refunds due.

Penalty:
The penalty for late filing under Section 234F or other provisions is typically Rs. 5,000 per return, but this can vary depending on the income, delay period, and whether the Assessing Officer chooses to impose it.

What to do now:
File the returns online or manually as soon as possible for all years due. Penalties may be waived or reduced if you explain the delay and if there’s no tax evasion.

Additional advice:
Since tax was deducted at source, filing returns will help claim refunds if excess TDS was deducted.
