16 October 2012 Hello all,

My company in which i have joined this october 2012 was incorporated on 27th march 2012. but the actual working was started from june end 2012. No document work or return filling work was done by it. as far as AGM is considered i'll arrange it before this 31st dec 2012. but I have confusion regarding Income tax return and Company audit... I would need to file the return for f.y. 27th march to 31st march 2012 or can file return next yr. also for company audit.....

Please help me I am in great confusion.

16 October 2012 yes, even your commercial production is not started, you have file return FY 2011-12. Even after due date you file return with penalty

16 October 2012 Yes.Since incorporation has happened in FY 2011-12 ,u must file returns.

16 October 2012 3rd proviso of section 139(1) says every company shall file return in respect of its INCOME or LOSS in every previous year. If there is no income or no loss return filing is not mandatory.
