Resignation of a default director

24 April 2012 Can u pls guide me wrt a director who has been listed as a default director as the company has not done its annual filings since 3 yrs.How can he come out of the company? And Form 32 for cessation shall not be accepted untill the annual filings are done.

I will suggest you to file Annual Filing which are not filed with MCA from removing the defaulter list.

After filing, you can file of form-32 of such director with ROC.
