A citizen of India leaving Indian for the purpose of employment on 24.04.2007 and finally coming back to India on 05.12.2008. what will be his residential status for the A.Y. 2009-10?

In the previous year 2008-09 he is india for 117 days. the relaxation in basic condition will be applicable only if he is going abroad for employment. here this is a case of coming back to india with no going back again. so he qualifies the second basic condition of 60 days & 365 days. so he is resident
